Couple Offered Deal After Sending Kid to Lower Moreland School

Parents will have to repay the school district around $10,750 to have their records expunged.

A Philadelphia couple who sent their daughter to Lower Moreland with a false Huntingdon Valley address could have their record expungued if they repay the tuition to Lower Moreland School District and complete a court-approved rehabilitative program.

Hamlet and Olesia Garcia faced charges of theft of services and conspiracy to commit theft of services for obtaining educational services in Lower Moreland Township without paying school taxes.

The out-of-district cost for tuition is about $10,752.81 per year, according to the Montgomery County Office of the District Attorney.

Philly.com published a story and Montgomery County Assistant District Attorney John Walko said there were about 15 similar cases in the district, but the Garcia's were the only ones to face criminal charges. Walko added that Lower Moreland contacted police because the Garcia's insisted their child was able to attend Lower Moreland.

The lawyer for the Garcia's says his clients are more than willing to repay the tuition, but do not plan to plead guilty to any crime.
